The President Has Not Just Refused To Faithfully Execute The Laws Of The United States, He Has Announced New Programs- And With Them Spending- Unauthorized By Congress.  The Question Is Now, What Can Be Done About It?

Before he enter on the execution of his office, he shall take the following oath or affirmation:--"I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”- Presidential Oath of Office, Article II Section 1, United States Constitution


Immediately following this year's election, a friend of mine, former politician, and life-long Democrat, stumbled in his attempt to rationalize the thumping his party had just taken.  He correctly labeled the election as a plebescite on Obama's policies but rather than accept the election's results for what they were, was searching for an excuse


“Do you think all of the accusations that President Obama is naive and unprepared to hold office a kind of equivalent of an October Surprise?” he asked.  “Not any more than the beating George W. Bush took through all eight years of his presidency,” I replied.

My friend just couldn't accept that outside of racism, the public could harbor anything but enthusiasm for Obama's “solutions.”  The public’s rejection couldn't have anything to do with them being ordered about by some left wing ideologue.  After all, the man is an international socialist, and tyrannize is what international socialists do.


Under Obama, Americans are required to buy health insurance and do so whether or not they are able to afford it.  Their children are also required

to eat their carrots.  And now, accept an invading horde of foreign invaders into their communities.


This latest edict from the president has him not only refusing to faithfully execute the laws of the United States, as he took an oath to do, he unilaterally established a program of registering illegal aliens, performing a background checks on them, and then allowing them to stay without fear of deportation.  It is unclear what fees the registrants might have to pay the government.


In ordering this program into being, the president assures us that none of this is “amnesty” and this program only applies to a select subset of illegals.


The problem the American public has with Barrack Obama is that they cannot trust him.  He has proven himself to be a pathological liar.


The Duplicitous President


This is something I’ve struggled with throughout my presidency. The problem is that I’m the president of the United States, I’m not the emperor of the United States.”- President Barack Obama, Feb. 14, 2013 admitting that he did not have the authority to halt deportations without an act of congress.

At the very opening of his speech, the president claims that “our immigration system is broken, and everybody knows it.”


Broken, oh, really?  In what way, and who would be the one who broke it?


While I would dare say that no one would claim that America's immigration laws are perfect, they would work well enough if the executive branch just enforced them.  If anything is broken, it is enforcement and Barrack Obama would be one who wrecked it.


Once upon a time, when an American political party took a pounding in an election, that party moved toward the center; that is, toward the policies of the overwhelmingly winning party.  As many pundits have opined, that rule does not apply anymore, and for a very good reason.  The Democrat's objectives are advanced at every election no matter who is the prevailing party.


Doubt this observation?  When Barrack Obama was elected in 2008, did he immediately act to overturn all of the Bush policies he had repudiated even before the campaign?  No he did not.  Why?  Bush's policies were pretty much Clinton's and before that his father's.


National policy is based on the wants of international corporations and upper tier billionaires.  Hence, the uniformity between presidential administrations.  For all of Obama's carping on the rich, he has made them more money in his six years in office than all other presidents combined.


That is why should Dubya's brother, Jeb, become president, the Obama policies of Common Core Education, massive immigration, and the war on terror will continue on unabated.  Readers might recall that it was Bill Clinton who enjoined with the Republicans on standardized testing and other policies.


It would also mean that the Federal Government will continue to grow like the proverbial leviathan. The bloat of government will also insure that the dwindling producer class will be taxed to the hilt in order to maintain the Federal apparatchiks.


None of this, of course, can be laid bare before the critical eye of the American public.  Take for example, MIT economist Jonathan Gruber's comment that “Lack of transparency is a huge political advantage.”  Obama's 2008 “Hope & Change” campaign was anything but transparent.  It plied on Gruber's, and the Democrat's, view that American voters are stupid and therefore gullible.


When the president was asked about Gruber he lied when he said, “The fact that some adviser who never worked on our staff expressed an opinion that I completely disagree with in terms of the voters, is no reflection on the actual process that was run.”


Oh, but it does, Mister President.  Gruber was quite explicit about how the ObamaCare scheme was unfeasible and for that reason the truth about ObamaCare had to be kept from the public.  The plan was so fiscally unsustainable, the Massachusetts law on which ObamaCare was based required supplemental funding from the Federal Government to the tune of hundreds of millions of dollars.


This same level of subterfuge and obfuscation can be found in matters as diverse as Federal spying on citizen cell phone and email accounts, the illegal gun running operation to Mexico code named “Fast & Furious,” and the use of the IRS as a political weapon.


Lois Lerner's thirty-thousand “lost” emails have just been found along with those of the other five (count 'em FIVE) hard drives assigned to other pertinent officials hard drives.  It is going to be sooo delicious to find out just what Lerner so desperately wanted to hide.

Eric Holder is also said to finally be forced by the courts into turning over sixty-thousand plus documents regarding Fast & Furious to congress.


Congressional Remedies That Could Be Taken To Rein In the Reign of His Excellency Barrack Obama


Of course, the president is not the first executive to tread on the Constitution.  Andrew Jackson did it in 1833 when he unilaterally withdrew taxpayer money from the Bank of the United States and deposited it in a multitude of state chartered banks, most run by leaders in his own party, the forerunner to the Democratic party of today.


Jackson also ignored an order by the Supreme Court of the United States in Worcester v. Georgia) where he was famously misquoted as saying, “John Marshall has made his decision, now let him enforce it!”  Jackson never made that statement.  However, he did act it out as if he had.


Congress did not impeach and remove Jackson from office.  Instead, it made a symbolic gesture in censuring President Jackson.  The modern day congress took a similar view of Attorney General Eric Holder when it held him in contempt, but did not criminally prosecute him.


A similar tactic could be used on  Obama.  Rather than impeach him, the House could censure him which would be only symbolic.  Congress could then put funding bills before the president that would deny him money to execute his plans.  And if Obama refused to sign them, then the blame for shutting down the government would then fall to the president.


The Prerogatives Of Congress


The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States;

To establish a uniform rule of naturalization, and uniform laws on the subject of bankruptcies throughout the United States.”- Article I Section 8, United States Constitution

No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time.”- Article I Section 9, United States Constitution


Clearly the president has no lawful power to create on his own new taxes, duties, imposts and excises on his newly protected illegal immigrants.  He would also have no power to make them citizens through a naturalization process.  Nor could he unilaterally expend money not appropriated by a contract with congress.


President Obama's edict is an attempt to further obfuscate the process, and unlawfully attempt to extort congress into enacting a law to his liking in a timeframe to his liking.  The president has no power to put congress on any timeline.  Hence, the president's dictates are particularly offensive.  One  can only imagine the outcry there would have been from Democrats if Bush 43 had attempted to extort and strong arm congress to  buckling under his will.


Congress Should Look To The Founding Fathers

The two principle tools congress has to curb executive power is that of funding and the impeachment-removal process.  Obama has arguably overstepped the boundaries of his constitutional powers many times.  The latest is an outrageous usurpation.  However, Republicans are unable to muster the courage to do what must be done.


Hence, the Republican reawakening in this last election could be short lived if they are not principled enough, courageous enough, to take on tyranny.


America loves a winner.  Unfortunately, within the Republican breast, it seems, does not reside a beating heart; at least not a heroic one.


Had John Boener and Mitch McConnell been the rebel leaders in 1776, we'd all be flying the Union Jack on Colonial Dependence Day.
